TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions govern access to and use of https://wostienda.com/ (the “Site”) and all purchases made through it.

The Site is operated by DOGO ENTERTAINMENT, C.U.I.T. No. 33-71761509-9, with registered address at Conesa 4560, Capital Federal, City of Buenos Aires, Republic of Argentina (“We”, “Us” or “Our”).

Any person who accesses, browses or purchases through the Site will be considered a “User”.

By using the Site and/or making a purchase, the User acknowledges having read and accepted these Terms and Conditions.

To make purchases through the Site, the User must be at least eighteen (18) years old or otherwise have sufficient legal capacity under applicable law.

2. Amendments

We may amend these Terms and Conditions whenever necessary, subject to the limitations established by applicable law.

Any changes will be published on the Site together with the date of the latest update.

Users are encouraged to review this section periodically.

3. Use of the Site

Users agree to use the Site in accordance with these Terms and Conditions and applicable law.

The Site may not be used for unlawful, fraudulent or abusive activities, or in ways that infringe third-party rights; interfere with its operation; introduce malicious code; gain unauthorized access to systems or information; collect third-party data without authorization; use false identities; or engage in any other conduct contrary to applicable law or these Terms and Conditions.

4. Products and availability

The Site offers official products related to WOS, including, among others, physical music releases, apparel, accessories, prints and merchandise.

All products are subject to stock availability at the time of purchase.

Certain items may be released as limited editions, and once sold out, restocking is not guaranteed.

Product information, availability, characteristics and prices may be modified without prior notice, without affecting purchases already confirmed.

Product photographs and images are for illustrative purposes. Minor variations may occur due to lighting, display settings, production or presentation.

5. Prices and currencies

For purchases made in the Republic of Argentina, prices are displayed in Argentine pesos (ARS).

For purchases made from other countries, prices are displayed in US dollars (USD).

The applicable currency and final amount will be shown to the User before the purchase is confirmed.

For international transactions, the User's bank, card issuer or payment service provider may perform currency conversions or apply its own exchange rates, fees or other charges in accordance with its terms.

Taxes included in prices will be displayed as applicable to each transaction. Taxes, import duties, tariffs and other charges that may apply to international orders are additionally governed by the relevant customs and international charges section.

6. Purchase process

To make a purchase, the User must select the product and, where applicable, its size, design or other variant; add it to the cart; provide the information requested during checkout; choose an available shipping and payment method; and confirm the order.

Before completing the purchase, Users are responsible for verifying that the products, quantities, variants, delivery address and all other information entered are correct.

Once the purchase has been registered, the User will receive the relevant communications at the email address provided during checkout.

Initial order confirmation does not necessarily constitute final acceptance of the transaction where payment issues, lack of stock, obvious listing errors or other legitimate circumstances prevent completion of the sale.

If an order must be cancelled after payment has been made, the corresponding refund will be processed through the payment method originally used, as applicable.

7. Payment methods

Available payment methods are those enabled at checkout at the time of purchase.

For purchases made in Argentina, available methods may include Pago Nube and Mercado Pago.

For international purchases, available methods may vary depending on the country, currency and payment processor conditions.

Transactions may be subject to controls and validations carried out by payment providers, banks or card issuers.

8. Invoicing

Purchases will be invoiced using the information provided by the User during checkout, in accordance with applicable tax requirements.

The User is responsible for entering the information required for invoicing correctly.

If an invoicing error is detected, the User must contact [email protected], including the order number.

9. Shipping within Argentina

Shipments within the Republic of Argentina are primarily handled through Shipnow and the logistics providers available through that service.

Shipping costs and available delivery options will be displayed at checkout according to the destination and characteristics of the order.

Delivery times are estimates and begin once payment has been confirmed and the order prepared.

Delays may occur due to circumstances involving the logistics provider, weather conditions, high-demand periods, force majeure or other circumstances outside the store's reasonable control.

10. International shipping

International orders are primarily handled through DHL Express.

Shipping costs will be calculated during checkout whenever automatic rate integration is available for the selected destination.

Delivery times provided by DHL Express are estimates and may vary due to customs procedures, inspections, destination-country restrictions, force majeure or other circumstances outside the store's control.

The automatic integration may currently experience difficulties with certain postal codes in Paraguay, Peru, Costa Rica and Venezuela.

For these destinations, the User may select the manual international shipping option where available. In such cases, once the order is received, we will calculate the shipping cost directly through the DHL Express platform and contact the User with the applicable amount.

Where an additional manually calculated shipping charge applies, it must be paid before the order is dispatched.

11. Customs, duties and international charges

International orders may be subject to taxes, import duties, customs fees or other charges established by the destination country.

Where such charges are not expressly included in the checkout amount, they are the responsibility of the recipient.

The store has no control over the criteria, amounts or procedures applied by customs authorities in each country.

Users are responsible for checking the import rules and restrictions applicable in their country before completing a purchase.

12. Shipping address

The User must provide a complete and accurate shipping address.

If an error is identified after completing the purchase, the User must contact [email protected] immediately, providing the order number and correct information.

If the order has not yet been dispatched, we will make reasonable efforts to correct the address.

Once the package has been handed over to the logistics provider, modifications may no longer be possible and may result in additional charges. Where the error in the address is attributable to the User, such charges will be the User's responsibility.

13. Exchanges, returns and right of withdrawal in Argentina

Without prejudice to mandatory consumer protection rights, for distance purchases made in Argentina, Users may exercise the statutory right of withdrawal within the legally applicable period, currently ten (10) calendar days from the execution of the contract or receipt of the product, whichever occurs later.

The right of withdrawal may be exercised through the Right of Withdrawal button available on the Site or through any other mechanism required by applicable law.

Costs arising from a return validly exercised under the statutory right of withdrawal will be governed by applicable law.

In addition, we offer a commercial exchange policy for domestic purchases. Users may contact us within fifteen (15) days after purchase to request an exchange of size, variant or product, subject to stock availability.

For voluntary exchanges, shipping costs are the responsibility of the buyer, unless the exchange is required due to an error by the store, an incorrect product, a defective product or another circumstance for which the store is responsible.

Products must be returned unused, in good condition and, where applicable, with their original packaging and accessories.

14. International exchanges

Voluntary exchanges of size, design, variant or product for international orders may be requested only before dispatch.

Once the order has been handed over to DHL Express, we are unable to process voluntary exchanges of size, design or product through the international shipping service.

If a modification can be made before dispatch and results in additional shipping or logistics costs, those costs will be the responsibility of the buyer unless the change results from an error by the store.

Nothing in this section limits or excludes any mandatory consumer rights that may apply under applicable law.

15. Damaged, defective or incorrect products

If a User receives a damaged, defective, incomplete or incorrect product, the User must contact [email protected], providing the order number and photographs of the product and, where possible, the packaging received.

We will review the case and provide an appropriate solution based on the circumstances and applicable law.

Costs necessary to remedy an error attributable to the store will not be passed on to the buyer.

Products are also covered by any statutory warranties that may apply.

16. Failed deliveries and returns to sender

Users must ensure that an authorized person is available to receive the order when required by the logistics provider.

Where a shipment cannot be delivered because of an incorrect address, repeated absence of the recipient, unjustified refusal to accept delivery, failure to pay customs charges for which the recipient is responsible, or another circumstance attributable to the User, the package may be returned to sender.

In such cases, additional return or reshipping costs may be charged to the User to the extent permitted by applicable law.

17. Resale

Products offered on the Site are intended for end consumers.

We reserve the right to cancel transactions where there are reasonable indications that purchases are being made for unauthorized commercial resale, fraud or misuse of the Site, subject always to applicable law.

18. Intellectual property

All content available on the Site, including trademarks, names, logos, designs, photographs, illustrations, graphics, text, audiovisual material, music, product images and other protectable elements, belongs to its respective owners or is used with authorization.

Access to the Site does not grant Users any intellectual property rights in such content.

Content may only be used for personal, non-commercial purposes related to browsing and purchasing through the Site.

Unauthorized reproduction, distribution, modification, commercialization or exploitation is prohibited.

19. Cookies and similar technologies

The Site may use cookies and similar technologies to ensure proper operation, remember preferences, analyze platform usage, improve the browsing experience and, where applicable, perform measurement or commercial activities.

Information obtained through these technologies will be processed in accordance with our Privacy Policy.

Users may manage cookies through their browser settings and/or tools made available by the Site. Disabling certain cookies may affect functionality.

Personal data processing is governed by our Privacy Policy, available on the Site.

When making a purchase, data necessary to manage the order, payment, invoicing, shipping, customer service and other purposes related to the transaction may be processed.

We do not intentionally seek to collect personal data from minors or allow purchases by individuals who lack legal capacity to contract.

If we become aware of such a situation, we will take the appropriate measures in accordance with applicable law.

22. Site availability and operation

We make reasonable efforts to keep the Site available and information up to date.

However, interruptions, technical errors, maintenance, third-party service issues or circumstances outside our control may occur.

We do not guarantee that the Site will be continuously available or error-free at all times.

Nothing in this section limits liability that cannot lawfully be excluded.

The Site may contain links to or integrations with services operated by third parties, including payment platforms, logistics providers and external websites.

Use of such services may be subject to the respective provider's terms, policies and conditions.

We do not control the content or independent policies of external websites.

24. Promotions

Promotions, discounts or special benefits may be subject to specific time periods, conditions, products, payment methods or territories.

Unless expressly stated otherwise, promotions may not be combined.

Specific conditions for each promotion will be displayed on the Site.

Any disputes will be submitted to the competent authorities and courts under applicable law, without affecting any non-waivable consumer rights.
